1. Nature of the Service

The services provided by Vighnahara BV (the “Platform”) operate as a neuro-symbolic agent. The Platform utilizes Artificial Intelligence to normalize and map your catalog and advertising data, paired with a strict, deterministic rules-engine to calculate margins and autonomously hunt financial leaks. While our margin calculations are strictly mathematical, the Platform is designed to function as an operational support tool, not as a substitute for your executive judgment.

2. System Architecture & Conversational AI

By using the Platform, you acknowledge and agree to the following regarding its neuro-symbolic architecture:

  • AI Data Normalization: The Platform utilizes generative AI models in its backend pipeline strictly to classify, size, map, and normalize messy raw catalog and advertising data from your connected integrations.
  • Deterministic Financial Core: The Platform's core detection engine—which calculates margins, generates health scores, and issues Margin Action Centre and Operations Action Centre tickets—does not use generative AI. It applies strict, deterministic mathematical rules to the AI-structured data. These calculations do not produce probabilistic outputs.
  • Conversational AI Interface: The Platform also includes a conversational interface (“Ask Gotama”) powered by generative AI (Google Gemini). While the underlying data queries are deterministic, generative AI models use probabilistic language generation to summarise data and answer queries. You agree to independently verify AI-generated conversational summaries against the raw evidence and citations provided in the Platform before taking action.
  • No Automated Execution: The Platform provides calculated suggestions and operational tickets to absorb marketing chaos and output financial precision. Vighnahara BV does not autonomously execute media buying changes, platform configurations, or financial transactions on your behalf without explicit human authorisation.

3. No Professional or Financial Advice

The content, charts, metrics, and AI-generated summaries provided by the Platform are for informational purposes only.

  • Not Financial Advice: Vighnahara BV is a technology provider, not a financial advisor, accountant, or business consultant.
  • No Eligibility Determinations: Vighnahara BV does not make lending, credit, insurance, employment, or other eligibility decisions, and does not act as a consumer reporting agency. Where you choose to share Platform outputs with a third party for such purposes — see Section 5.6 of the Terms of Service — that third party is solely responsible for its own decision and its own compliance.
  • No Guarantee of Results: Past performance metrics or AI predictions regarding future performance (e.g., “Expected ROAS”) are estimates only. We do not guarantee specific financial outcomes, revenue growth, or profitability.

4. Data Privacy & AI Training

To address your data privacy concerns regarding AI usage:

  • Zero Training Policy: Vighnahara BV explicitly warrants that your proprietary business data (including orders, customer lists, and marketing performance) is NOT used to train, retrain, or improve the foundational models of Google Gemini or any other third-party AI models.
  • Data Isolation: Your data is processed in an isolated environment. The AI only “sees” the data necessary to answer your specific query or generate your specific response, after which the context is discarded by the model.

5. Third-Party Data Dependency (“Garbage In, Garbage Out”)

The accuracy of our insights is entirely dependent on the quality of data we receive from your connected platforms (Shopify, Meta, Google).

  • Platform Errors: Vighnahara BV is not liable for errors in analysis that stem from incorrect, delayed, or malformed data sent by these third-party platforms.
  • API Limitations: If a third-party platform changes its data definitions (e.g., how “Attributed Sales” are calculated), our historical comparisons may be temporarily affected.

6. Limitation of Liability

To the fullest extent permitted by Dutch law, Vighnahara BV shall not be liable for any direct, indirect, incidental, or consequential damages (including loss of profits or revenue) resulting from:

  • Your reliance on the AI-generated conversational summaries or recommendations provided through the “Ask Gotama” interface.
  • Inaccuracies in the data provided by connected third-party tools.
  • Temporary unavailability of the AI service due to provider (Google) downtime.
  • Actions taken based on the Platform's deterministic calculations without independent verification of the underlying data quality.
